A San Diego man was arrested earlier this month after authorities discovered that he was allegedly running a pirated games business out of his home, adding mod chips to Xbox and Xbox 360 consoles, then adding hard drives filled up with pirated games:

In his home, Brown had over a thousand copies of pirated games as well as a large number of mod chips. Brown had allegedly built up a thriving business selling counterfeit games and installing mod chips, having advertised his services on Craigslist and other web sites.

Although he does face charges related to the DCMA for selling chips that are used to get around copy protection, I disagree with characterizing this as a "modder" being arrested. He's selling pirated games. I doubt anyone who region-mods their game console has anything to worry about.
