An EB employee tells The Consumerist that the actual game was missing several Guitar Hero III bundles at his store. The problem came to light when a customer tried (and failed) to return his copy because it lacked that rather key item, thus prompting the store manager to pop open several other boxes:

[A]fter checking out all of our latest GH3 360 shipments and finding out that each and every box LACKED the actual game, we immediately emailed corporate about it.

It's probably an isolated incident, but open up your game in the store just to be on the safe side. Most retail outlets won't let you return opened software, but they're going to have a hard time accusing you of pulling a fast one if you open the box right in front of them.
